By using or accessing our website and / or placing any order(s), you agree to be legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions then you may not use or access our website or place orders. These terms relate to sales over the Internet and over the telephone with E Com Sales Ltd. The contract you make online with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you.

You should not proceed with your purchase until you have read and agreed to these terms and conditions.

Applicable Law:

E Com Sales Ltd control and operate the website from our offices within England. Accordingly, the laws of England and Wales govern claims relating to, including the use of, this website and the materials contained therein. If you choose to access our website from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between E Com Sales Ltd and the customer, the laws of England and Wales will apply at all times.

Delivery:

 

Couriers and Services:

Due to the size differences in our items, we use two delivery methods:

  • Parcel Deliveries by Courier (Usually DHL)
  • Pallet Deliveries by Haulage

Larger items are delivered on a pallet with using our pallet distribution network, which usually takes approximately 3 - 5 working days. 

A Next Day Pallet Delivery can also be arranged with us or on line at an Extra Charge

A convenient delivery time will be booked in with the customer when the goods arrive at the local depot.  

All parcel deliveries are sent on a standard 48 hour courier service, a 24 hour service is available at an additional charge.

Normal delivery hours are Monday to Friday between 09:00 and 17:00.

Once despatched, delivery address details cannot be amended, unless there is a foreseeable problem delivering to the address specified.

Events beyond our control can lead to a delayed delivery, therefore we cannot be held responsible for any losses incurred as a result, including the booking of tradesmen and loss of earnings. We will 48 hours for customers to check for any transit damages or visible flaws. 

Delivery Locations:

We only deliver to the United Kingdom, delivery surcharges apply for some mainland and all non mainland postcodes.

These areas include, but are not restricted to, the following locations:

  • Channel Islands
  • Scottish Highlands
  • Scottish Islands
  • Isle of Man
  • Isle of Wight
  • Scilly Isles
  • Northern Ireland

 

If you wish to order an item and live in one of these areas, please call us for a delivery quotation prior to purchasing. Any orders received from these areas without prior arrangement will be subject to a delivery surcharge. This surcharge varies by location and can be taken over the telephone prior to despatch.

 

Signing For Deliveries:

All deliveries must be signed for, no delivery can be made without a signature from the customer or nominated receiver. The customer will be liable for any delivery shortages if signing for goods as "unchecked", unless we are notified of the shortage within 7 days of receipt of the goods.

 

Checking Deliveries and Damaged Goods:

All goods must be checked for damages before signing for deliveries; any damaged goods must be signed for as damaged. The customer will be liable for any goods not received, or received as damaged, which have not been signed for as damaged at the point of delivery. All damages must be reported to us within one working day of delivery.

We may require photographic evidence of damaged goods in order to facilitate an exchange or refund.

When checking goods, please ensure that all items have been delivered and that the only the number of parcels received are signed for. It is in our contract with the delivery agents to allow reasonable time for this check to take place.

If the delivery agent damages the goods during the course of delivery, our liability is limited to the repair, replacement or refund of the goods or the value thereof.

 

Carry In:

For deliveries of larger sized goods, an appointment is made between the customer and the courier prior to delivery. In the unlikely event that the delivery agent is not insured or able to do so, it is the customer's responsibility to ensure that a minimum of two people are available to lift the goods into your home.

 

Missed Deliveries:

If, for any reason, the courier was not able to deliver goods, a card will be left to notify the customer of a missed delivery. The courier will only attempt to re-deliver the goods twice. If the customer is still not available to receive the goods, they will be returned to us and the customer will be liable for any further re-delivery charges.

For large pallet deliveries, due to the size and nature of the delivery, only one delivery attempt will be made. This is made by appointment and therefore should not be missed. If this appointment is missed, an aborted delivery fee will be charged and a re-delivery fee will also apply.

 

Combined Deliveries:

Where combinations of goods are purchased, only one delivery fee will be charged. If the goods include an item that requires a pallet delivery, any parcel sized items will be included in the same delivery

 

Changes to Orders:

Any changes made to the goods within an order, after the order has been processed, will have an impact on the delivery timescale. Therefore, it may not be possible to deliver goods by the original confirmed delivery date. The customer will be liable for any additional or subsequent charges made by the delivery agent resulting from a change to an order.

 

Safe Access:

You are responsible for providing a safe means of access from the public highway to the place of delivery. If the delivery agent considers that access is unsafe, the delivery cannot be made until safe access is provided. The customer will be liable for any subsequent charges by the delivery agent in such a situation.

 

Returns:

All returns are accepted in line with the Office of Fair Trading's Distance Selling Regulations in the UK.

 

Return of Goods Following Cancellation:

If you wish to cancel your order, please follow the steps below. You must give us notification in writing or by other durable medium (including email) of the cancellation within 7 days after the day you receive the order.

  • Obtain a returns form and authorisation number from our customer services department.
  • Fill in and return the form, and attach a copy to the goods being returned.
  • Return the goods to us, by a tracked or signed method.

 

Goods to be returned must be undamaged, complete, unused and with their original packaging. Do not allow carriers or any other party to destroy any packaging, the packaging is specifically designed for each piece and is deemed as part of the item.

We will not be held liable for the loss or damage of any goods on return to us, it is therefore in your interest to ensure that the goods are returned insured, using a tracked or signed for service.

After the statutory 7 day period has expired we will be unable to accept the return of any goods unless they are deemed faulty.

It is the customer's responsibility to pay for the return of goods following the cancellation of an order. On receipt of the goods in a satisfactory condition, we will refund the original purchase price of the goods.

Subject to your statutory rights, goods which are custom made or altered to suit requirements may not be returned, nor will we provide any refund, unless they are defective or have been damaged during the course of delivery.

Returns outside 28 days will not be accepted. Any returns notified after 7 days but within 28 days may be subject to an additional 20% restocking charge. On cancellation for any reason, you must return the goods at your own cost unless we agree otherwise or we confirm that you may dispose of the goods.

 

Duty of Care:

It is the customer's responsibility to take reasonable care of the goods while in their possession, any damages resulting in a failure to exercise that care will be charged for accordingly.

Product Specifications:

We and our suppliers have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to future sales. This includes adjustments to sizes or ornamental detailing on individual items.

As a consequence, products supplied may have minor differences from those advertised. Unless agreed with you, the products supplied will be of an equivalent value, functionality and appearance. The customer is obliged to check any such goods on receipt and is at liberty to return them if they see fit within seven days after the day of purchase.

All dimensions specified by us are approximate. We allow a tolerance of up to 10mm for ceramic goods due to the nature of their production, small vatiances in shapes are deemed a typical characteristic of this type of product.

All of our wooden bathroom furniture is made from quality natural wood and accordingly appearances may vary. Some woods will mellow with age and exposure to sunlight. When purchasing wooden furniture please be aware that no two pieces are the same. Varying degrees of purpose distressing and antiquing are generally applied to each piece; this is very much intended and makes each piece totally unique, as desired by the craftsmen.

Due to the natural condition of the wood, distressing varies from piece to piece; this may include wood splits and knots. In certain cases, filler may be used to maintain a smooth surface finish; this is considered a normal part of the manufacturing process.

We endeavour to display as accurately as possible the colours of our products that appear on the website. However we cannot guarantee the complete accuracy of the pictures or photographs that are shown. Many conditions such as monitor settings and batching can affect the colouring of items in a picture.

 

Prices:

All prices Include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.

We regularly promote offers on ranges and individual items, which can result in the items being ordered subsequently being sold at a lower (or higher) price. As soon as orders are placed on the website, orders are processed to a dispatch team, and space booked on delivering vehicles. This is an operation that takes time and reserves space with haulage service providers, at a cost to us. If items are reduced in price on the website prior to delivery; the price paid during checkout still applies.

The prices displayed on the website are for on-line purchases and promotions only and are not transferable to sales through any other means.

The prices displayed on the website in relation to any on-line promotion are valid strictly until midnight on the day on which the promotion expires, as determined by us.

We will not be bound to honour any prices, where we have indicated to you subsequently that the prices displayed have been displayed in error. In these cases a refund will be offered.

 

Payment:

You must pay by credit, charge or debit card at the time of order. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website will be correct; that the credit charge or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.

Payment is taken in full at the time of the order.

The contract shall not have been concluded until we have completed all of the following steps:

  • We have received your valid credit or debit card payment details
  • We have accepted your online order and sent you confirmation by return email.

 

We reserve the right to refuse any order placed by you.

In the unlikely event that items ordered are out of stock, a full refund will be provided within three working days.

 

Guarantees and Claims under Guarantee:

The provisions of these clauses apply in addition to your statutory consumer rights in relation to faulty or miss described products. These rights are not affected by the guarantee.

These guarantees do not cover fair wear and tear and the characteristics of natural products including the movement in wooden products; neglect; abuse or misuse of your goods in failing to follow correct care procedures, including the oiling and waxing of furniture; loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party.

 

Natural Products:

Wooden bathroom furniture, on rare occasions, due to climate changes, may swell. This can make doors or drawers stiff to open. It is important not to return or refuse such an item if this is the case. Usually this problem will rectify itself in a matter of days once the timbers adjust to their new environment, alternatively, you may find that simply swapping drawers will remedy this.

On rare occasions, including a permanent change in environment, movement may not settle and it may be necessary to sand or shave a small amount from a drawer or door. This should be undertaken by a skilled craftsman at the expense of the customer. We recommend a coat of Danish oil to protect any adjustments made. Please bear in mind that wood is a natural product, and swelling and movement of timber is rare, but a possibility. Therefore stiff drawers or doors will not be deemed as defective or faulty and any necessary adjustments needed would have to be undertaken by the customer.

If a wooden product is delivered in such a condition and it is not the wish of the customer to undertake any necessary adjustments, a refund or replacement can be made during the seven day grace period.

We guarantee all products against faulty workmanship and/or faulty materials for a period of 12 months from the actual date of delivery.

It is our responsibility to arrange for the repair or replacement of any faulty or incorrect goods. Should a replacement no longer be available, or if circumstances determined by the seller make a replacement impractical, it may be replaced with a part that most closely matches it. Alternatively, at the discretion of the seller, an allowance may be made for the customer to arrange a local repair.

We will not be liable for any damage or loss resulting from repairs attempted by the customer or third parties.

We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. This does not affect your statutory rights.

 

Privacy Policy and Data Protection:

E Com Sales Ltd is registered as a Data Controller in accordance with the Data Protection Act of 1998.

We will only use the information provided by you lawfully, in accordance with the Data Protection Act of 1998. The information collected, includes names, telephone numbers, e-mail addresses and postal addresses.

From time to time we may choose to send you offers or updates via email. By making a purchase you agree to us sending you this information, however, you may opt out at any time if you do not wish to receive further correspondence.

All personal information is held and transmitted securely and will never be passed to a 3rd party without prior authorisation.
